Resumen:

Preso atto che la crisi pandemica ha messo a dura prova l’attività essenziale della giurisdizione, il saggio evidenzia l’importanza di promuovere l’implementazione di percorsi stragiudiziali e di rilanciare la negoziazione assistita dagli avvocati in separazione e divorzio. La legge n. 162/2014 - imponendo sistemi compositivi e non antagonisti - potrebbe rivelarsi un rilevante strumento di coesione sociale idoneo, al contempo, a garantire una normalizzazione della crisi familiare.

Abstract:

Considered how the pandemic crisis has affected the essential activity of the jurisdiction, the essay highlights the need to promote the implementation of out-of-court procedures and to relaunch assisted negotiation by lawyers in separation and divorce. Law n. 162/2014 - imposing compositional and non-antagonic systems - could be an important instrument of social cohesion suitable, at the same time, to guarantee the normalization of family crisis.
