Eletronic Contracts: Concept, Formation and Right of Repentance under Brazil's Law

Resumen:

Este trabalho pretende analisar o momento de formação do contrato eletrônico, a fim de delimitar se efetivamente se trata de um contrato entre ausentes ou um contrato entre presentes. Ao mesmo tempo, discute-se as consequências jurídicas daí decorrentes, como a responsabilidade pela validade da oferta e a eventual (in)existência do direito de arrependimento. Em sede de conclusão, pretende-se deixar clara a posição adotada, a fim de trazer melhor solução ao problema enfrentado.

Abstract:

This paper intends to analyze the moment of formation of the electronic contract, in order to delimit if it is effectively a contract between absentees or a contract between present. At the same time, the resulting legal consequences are discussed, such as the responsibility for the validity of the offer and the possible (non)existence of the right to repent. In conclusion, it is intended to make clear the position adopted, to bring a better solution to the problem faced.
