Hiring of mobile telephony by minors: validity and nullity

Resumen:

Tras la aparición de la telefonía móvil en la sociedad, se ha observado cómo ciertos menores han realizado operaciones contractuales relacionadas con la compraventa de tales dispositivos y la adquisición de una tarjeta SIM prepago o tarifa móvil. Ello sin la asistencia de sus representantes legales. Ante tal situación –que se plasma en diferentes consultas legales y dentro de la jurisprudencia– resulta de interés atisbar si los menores de edad poseen capacidad de obrar para realizar tales negocios jurídicos. Para responder a tal cuestión se realizará un examen de la legislación, doctrina y resoluciones judiciales relacionadas con la materia. Su análisis nos permitirá observar el paulatino abandono de la tesis de la nulidad absoluta y el acogimiento de la posible validez de tales operaciones contractuales, en defensa de la capacidad limitada y progresiva del menor.

Abstract:

After the appearance of mobile telephony in society, it has been observed how certain minors have carried out contractual operations related to the sale of such devices and the acquisition of a prepaid SIM card or mobile rate. This without the assistance of their legal representatives. Faced with such a situation - which is reflected in different legal consultations and within jurisprudence - it is of interest to see if minors have the capacity to act to carry out such legal businesses. To answer this question, an examination of the legislation, doctrine and judicial decisions related to the matter will be carried out. Its analysis will allow us to observe the gradual abandonment of the thesis of absolute nullity and the acceptance of the possible contractual validity of such contractual operations, in defense of the limited and progressive capacity of the minor.
