Consumers and energy prosumerism in the European regulatory framework

Consumatore e prosumerismo energetico nel quadro regolatorio europeo

Resumen:

Comprendere l’evoluzione della definizione di consumatore permette di individuare in quale modo operi il prosumerismo nel mercato energetico.Il prosumer costituisce il punto di arrivo di un’evoluzione delle esigenze di protezione dei contraenti c.dd. deboli in mercati quali quello bancario e finanziario dove la giurisprudenza della Corte europea, utilizzando l’arma dell’interpretazione funzionale, ha piano piano ampliato l’ambito di tutela. Si pensi all’elaborazione della categoria dei “contratti a duplice scopo” e all’applicazione delle tutele del consumatore anche quando sia presente un’attività professionale purché “marginale”.Il prosumer, consumatore che produce l’energia che utilizza, è al centro del nuovo quadro regolatorio europeo quale attore chiave del nuovo mercato energetico decentralizzato. Le Direttive europee n. 2001 del 2018 e n. 944 del 2019, recepite dall’Italia rispettivamente con i d.lg. 199 e 210 del 2021, affinano la protezione del cliente energetico con una tutela differenziata che tiene conto sia delle modalità di consumo (individuale o collettivo) e di produzione (comunità energetiche), sia della vulnerabilità dei consumatori energetici.

Abstract:

To understand who the consumer is helps us to identify how prosumerism operates in the energy market. The prosumer constitutes the arrival point of the defense of the weaker party in markets, such as the banking and financial ones, where the Court of Justice’s case-law used the weapon of the “functional interpretation” to gradually enlarge the object of the protection. The main steps of this path are constituted by the category of "dual purpose contracts" and the application of consumer protection even where there is a professional activity provided that it is "marginal". The energy prosumer is at the hearth of the new European regulatory framework; he is a key player in the new decentralized energy market. The EU Directives 2001/2018 and 944/2019, in Italy respectively implemented by the Legislative Decree 199 and 210/2021, modulated the protection through a multi-level approach on the basis of the types of energy consumption (individual or collective) and energy production (energy communities) and level of vulnerability of each energy consumer.
