General terms and conditions of the contract in online betting

Resumen:

En el presente trabajo su autor analiza las condiciones generales de la contratación en un ámbito muy concreto que son las apuestas online. Para ello, se procede al estudio de las resoluciones judiciales en las que se han declarado nulas por abusivas determinas cláusulas; a modo de ejemplo se pueden enunciar: aquellas que permiten que sea la casa de apuestas la que decide cuando cerrar o suspender las cuentas de los usuarios; o aquellas que permiten anular la apuesta alegando errores en la determinación de la cuota. A partir de las conclusiones obtenidas, se procede a analizar las condiciones generales de la contratación de dos casas de apuestas como son Sportium y Bet365, con el fin último de poder identificar cláusulas que en un futuro se podrían llegar a considerar nulas por abusivas. Finalmente, se destaca la importante función que puede desarrollar en la práctica el sistema arbitral de consumo.

Abstract:

In the present work the author analyzes the general terms and conditions of the contract in the very specific field of online betting. For this purpose, the court rulings, which have been declared null and void because of their abusive nature, would be analyzed; as an example: those clauses that allow the betting houses to decide when to close or suspend the user’s accounts; or those clauses that allow the betting houses to void the bet alleging the existence of errors in the determination of the odds. Based on the conclusions obtained, the general terms and conditions of the contract of two bettings houses such as Sportium and Bet365 will be studied, with the purpose of identifying clauses that in the future could be declared null and void because of their abusive nature. Finally, the important role that the consumer arbitration system can play in practice is highlighted.
