Resumen:
En el artículo se realiza un resumen de los cambios que en materia de fuentes de la filiación se han introducido en el ordenamiento jurídico cubano tras la aprobación en septiembre de 2022 del Código de las familias. Se parte de una explicación del sistema de fuentes que operaba con precedencia, y se estudia la coherencia con el sistema constitucional la introducción por la nueva ley sustantiva familiar de otras fuentes de la filiación, con la reglamentación de las técnicas heterólogas de reproducción asistida, la aplicación de técnicas homólogas con efecto post mortem, o la regulación de la gestación solidaria y de la multiparentalidad. Se analizan en cada caso los elementos y características de las figuras, así como cuestiones críticas de algunas de estas.
Abstract:
The paper summarises the changes that have been introduced in the Cuban legal system regarding the sources of filiation after the approval of the Family Code in September 2022. It starts with an explanation of the system of sources that operated in the country before, and studies the coherence with the constitutional system of the introduction by the new substantive family law of other sources of filiation, with the regulation of heterologous assisted reproduction techniques, the application of homologous techniques with post-mortem effect, or the regulation of surrogate motherhood and multiparenthood. In each case, the elements and characteristics of the figures are analysed, as well as critical questions of some of these.
