Brief legal considerations on dying in Coronavirus times in Spain

Las normativas que se han dictado durante el estado de alarma en aras de conformar una estadística fiable sobre los fallecimientos y con fines epidemiológicos han dejado de lado al Registro Civil y han repercutido negativamente en la sociedad española. Las presentes líneas pretenden identificar y analizar críticamente las distintas disposiciones jurídicas que se han dictado al respecto. Además, de valorar si el Registro Civil está en condiciones de contribuir a la conformación de una estadística de defunciones completa y objetiva que garantice el derecho a la información de los ciudadanos y permita tomar decisiones eficaces en sede epidemiológica respecto a la pandemia de COVID-19.
Abstract:
The regulations that have been issued during the state of alarm in order to establish a reliable statistic on deaths and for epidemiological purposes have neglected the Civil Registry and have had a negative impact on Spanish society. These lines are intended to identify and critically analyze the different legal provisions that have been issued in this regard. In addition, to assess whether the Civil Registry is in a position to contribute to the creation of a complete and objective death statistic that guarantees the right to information of citizens and allows effective decisions to be made in epidemiological terms regarding the COVID-19 pandemic.
