Approach to Smart Contracts from an International Private Law Point of View

Resumen:

A través de este trabajo se trata de realizar un estudio en relación al marco normativo de los Smart contract o contratos inteligentes. De esta forma, partiendo de una conceptualización propia, se trata de hacer una profundización en la normativa, que les resultará aplicable, para finamente tratar de determinar la Ley aplicable a estos contratos, a través de las normas de Derecho internacional privado.

Abstract:

Through this work we try to carry out a study in relation to the regulatory framework of the Smart contract or intelligent contracts. In this way, starting from their own conceptualization, it is a matter of making a deepening of the regulations, which will be applicable to them, to finally try to determine the Law applicable to these contracts, through the rules of private international law.
