Resumen: El presente artículo colabora a perfilar el alcance de la prohibición de disponer unilateralmente, por uno de los cónyuges, de la vivienda familiar, que contiene el artículo 1320 CC, ya sea por la introducción de nuevas realidades, como la vivienda colaborativa, o clásicas, como la reserva de usufructo. Se trata de definir mejor el objeto de protección y los actos que puedan atentar contra él.

Abstract:

Abstract: This article contributes to outlining the scope of the prohibition on unilaterally disposing of the family home by one of the spouses, contained in Article 1320 of the Civil Code, either by introducing new realities, such as collaborative housing, or classic ones, such as the reservation of usufruct. It is a matter of better defining the object of protection and the acts that may threaten it.
