Powers of disposal of collective property: reasons, limits and perspectives.

Resumen:

I beni di collettivo godimento, in quanto patrimonio originario, materiale e immateriale, delle collettività cui appartengono, sono soggetti ad un regime giuridico di indisponibilità particolarmente rigido che però ne ha consentito nel tempo la conservazione come comproprietà inter- generazionale. Ragioni economiche ed interventi antropici di irreversibile trasformazione spingono il legislatore attuale a trovare soluzioni normative adeguate che sappiano conciliare la tutela delle risorse naturali, dell’ambiente e del paesaggio con le esigenze di produttività e di uso, sempre responsabile, ma innovativo, legato anche alla green economy. Il saggio si propone di esaminare tali nuove dinamiche che inevitabilmente coinvolgono anche un ambito dominicale tanto antico qual è quello delle proprietà collettive.

Abstract:

Assets of collective enjoyment, as original heritage, material and immaterial, of the communities to which they belong, are subject to a particularly rigid legal regime of non-availability that has, however, allowed their preservation over time as inter-generational co-ownership. Economic reasons and anthropic interventions of irreversible transformation are pushing today's legislators to find adequate regulatory solutions that are able to reconcile the protection of natural resources, the environment and the landscape with the needs of productivity and use, always responsible but also innovative, linked to the green economy. The essay sets out to examine these new dynamics that inevitably also involve such an ancient dominical sphere as that of collective property.
