Resumen:

Il saggio analizza il tema della tutela dei minori stranieri non accompagnati nel più ampio e complesso quadro dei fenomeni migratori. Muovendo dall’esame della legge n. 47/2017 si opera una riflessione sulle principali questioni che si pongono in relazione all’ingresso nel territorio italiano dei minori stranieri non accompagnati. In questo scenario si innesta il recentissimo d.l. n. 123/2023 che - ad una prima lettura - lascia trasparire alcune questioni problematiche rispetto alle misure di prima accoglienza e all’accertamento anagrafico.

Abstract:

The essay analyzes the topic of protection of unaccompanied foreign minors in the broader and more complex context of migratory phenomena. Starting from the examination of law no. 47/2017 a reflection is carried out on the main questions that arise in relation to the entry into Italian territory of unaccompanied foreign minors. The very recent legislative decree is inserted into this scenario. n. 123/2023 which - at first reading - reveals some problematic issues with respect to initial reception measures and demographic verification.
