Resumen:

Lo scritto esamina la problematica della rinuncia alla prescrizione e alla decadenza, indagandone la natura giuridica, la struttura, la funzione e le regole disciplinari. Da queste, ed in particolare dalle disposizioni del codice civile italiano, si evince il carattere generale delle norme poste in tema di decadenza e viene confermata l’opportunità di ricostruire in chiave unitaria il sistema delle limitazioni temporali, comunque denominate.

Abstract:

The paper examines the issue of waiver of prescription and forfeiture, investigating its legal nature, structure, function and disciplinary rules. From these, and in particular from the provisions of the Italian civil code, the general nature of the rules regarding forfeiture is evident and the opportunity to reconstruct the system of temporal limitations, however named, in a unitary way is confirmed.
