Safeguard of young athletes between sport’s specificity and EU’s law.

Resumen:

Il saggio affronta problematiche relative ai rapporti tra le regole sportive e il diritto comunitario, analizzando le sentenze della Corte di Giustizia, dal caso Walrave a quello Meca Medina, che più di altre hanno inciso su tale relazione. In seguito, l’esame si incentra sulla tutela del giovane atleta tramite la valutazione delle regole federali che potrebbero essere d’ostacolo alla realizzazione di principi di matrice europea. Nello specifico, vengono presi in considerazione il c.d. vincolo sportivo e le indennità di formazione, al fine di valutarne eventuali profili di invalidità nel confronto con la funzione sociale ed educativa dello sport di cui all’art. 165 TFUE.

Abstract:

This essay confronts issues related between the relationship of sport rules and EU’s law, analyzing the Court of Justice’s judgments, from cases Walrave to Meca Medina, which have affected more than others on that relationship. Later, the study focuses on the safeguard of the young athlete through the evaluation of the federal rules that could be an obstacle to the realization of European values. Specifically, this essay considers the so-called sport bond and the training fees, in order to assess any invalidity profiles in comparison with the social and educational role of sport of the art. 165 Treaty on the Functioning of the European Union.
