Regulation of the Right of Visits for Grandparents under Chilean Law

Resumen:

En este trabajo se analizan las modificaciones introducidas en el Derecho chileno en materia de Derecho de Visitas (o de “Relación Directa y Regular”), por la Ley N° 20.680. En específico, se revisa críticamente una de sus principales innovaciones, cual es la incorporación de la posibilidad que se establezca un régimen de visitas entre los abuelos y los nietos, regulada en el nuevo artículo 229-2 del Código Civil. Analizadas las características de esta nueva disposición, se estima que pese a ser un avance respecto de la situación anterior, todavía falta una regulación orgánica, pues el legislador establece de forma muy básica este derecho a favor de los abuelos. Por ejemplo, no queda claro si ellos son titulares o no del derecho a mantener contacto con sus nietos.

Abstract:

This paper analyzes the amendments enacted in Chilean Law regarding the Right of Visit (so-called “Regular and Direct Relationship”), under Law N° 20,680. Specifically, it critically reviews one of its major innovations, which is the incorporation of the possibility to establish a visitation regime between grandparents and grandchildren, regulated in the new Article 229-2 of the Chilean Civil Code. After analyzing the characteristics of this new provision, the author reflects that despite being an improvement to the previous situation, proper organic regulation is still missing, as the law sets forth this right only minimally in favor of grandparents. For example, it is unclear whether they are or are not entitled to maintain contact with their grandchildren.
