Civil Repercussions of the Exercise of Follow-On Actions Derived from the European Truck Cartel

Resumen:

En el presente trabajo se intentará dar respuesta a una serie de interrogantes que se plantean en relación a la interposición de acciones de responsabilidad civil extracontractual, derivadas del cartel entre fabricantes de camiones europeos que afectó entre los años 1997 y 2011 a 10 millones de camiones. Para ello, se prestará especial atención a dos aspectos claves para el ejercicio de las mismas, como son, el de la determinación del plazo de prescripción de la acción y, el relativo a la difícil tarea de cuantificar el posible daño sufrido por el consumidor.

Abstract:

This paper will try to answer a series of questions that arise in relation to the filing of extra-contractual civil liability actions, derived from the cartel between European truck manufacturers that affected 10 million trucks between 1997 and 2011. For this, special attention will be paid to two key aspects for the exercise of the same, such as the determination of the limitation period of the action and the one related to the difficult task of quantifying the possible damage suffered by the consumer.
