Resumen:

La capacidad de obrar en el Derecho español es uno de los aspectos más relevantes para el Derecho Civil y el Derecho Privado en general. Es un tema de gran interés por su directa relación con el principio de autonomía de voluntad y cuya intensidad varía dependiendo del negocio jurídico en cuestión. Recientemente, el Tribunal Supremo ha estudiado la capacidad para disponer por testamento de una persona con capacidad de obrar modificada judicialmente.

Abstract:

The ability to act in Spanish law is one of the most relevant aspects for Civil Law and Private Law in general. It is a subject of great interest because of its direct relationship with the principle of autonomy of will and whose intensity varies depending on the legal relation. Recently, the Supreme Court has studied the ability make a will of a person with the capacity to act judicially modified.
