Resumen:
El presente estudio aborda, en su primera parte, el tema de la responsabilidad civil del árbitro, con un análisis de los presupuestos que han de concurrir para que se origine. De igual modo, se abordan los casos en que la indemnización debe pagarla la institución arbitral que responde por los hechos dañosos de sus árbitros (responsabilidad civil por hecho ajeno), así como también por su propia negligencia en la administración y dirección del arbitraje (responsabilidad por hecho propio). En la segunda parte, se plantean las mismas cuestiones respecto de la responsabilidad civil de los mediadores y de las instituciones de mediación.
Abstract:
The study analyses, in its first part, the subject of the civil liability of referees, with an analysis of the requirements that must be met so that it be originated. Also, it studies the cases in which the damages have to be paid by the referee's institution that has civil liability by the harm facts of the referees (vicarious liability), and also by its own negligence in the administration and direction of the arbitration (personal liability). In the second part, the study analyses the same questions but concerning the civil liability of mediators and of mediator's institutions.
