“Selecting for disability”: parents' desires against the best interests of the child

Resumen:

En el presente estudio, tras exponer en qué consiste la controvertida figura conocida como “selecting for disability” y mencionar brevemente el régimen jurídico de algunos de los países que permiten la selección embrionaria, incluido España, reflexionaremos sobre si dicha selección, en el caso de que se encuentre dirigida voluntariamente a que los menores porten algún tipo de discapacidad, puede reportar algún beneficio al interés superior de éstos o si la referida práctica puede tener cabida en el derecho humano a la salud.

Abstract:

In the present study, after introducing the controversial notion of “selecting for disability” and briefly mentioning the legal regime of some of the countries that allow embryo selection, including Spain, we will reflect on whether the voluntary mentioned selection, in the case that it is be aimed towards disability, may bring any benefit to the minor’s best interests or if the referred practice may be well accommodated into the human right to health.
