Determining the interest of the child before blockchain

Resumen:

El presente artículo analiza la situación legal y tecnológica de blockchain en Europa y su eventual desarrollo en España ante la escasez regulatoria. Corresponderá a los diferentes Estados determinar las estrategias oportunas que inviten a los menores a aprender sobre el manejo de estas tecnologías y sus posibles impactos. La tendencia será la búsqueda de respuestas legales que permitan evitar cualquier vulneración de sus derechos e intereses. Con este horizonte, pretendemos estimular la reflexión, estudiar su futura regulación, junto a las potenciales medidas de prevención, así como, discutir acerca de esta tecnología tan compleja, controvertida y de rápida evolución.

Abstract:

This paper reviews the current legal and technological situation concerning Blockchain in Europe and its eventual development in Spain. Governments will certainly encourage children to learn about the use of these technologies and their potential impacts. The trend will be to search for legal responses that prevent any violation of their rights and interests. With this in mind, we aim to stimulate reflection, study its future regulation, potential preventive measures, and discuss this complex, controversial, and rapidly evolving technology.
