Resumen:
Este trabajo analiza cómo determinar la filiación en las hipótesis de embriones incorrectamente implantados debido a un error médico. Hay una amplia variedad de casos que reflejan la tensión existente entre las concepciones biológica y social de la paternidad: en ocasiones una mujer lleva en su útero un embrión que genéticamente pertenece a otra pareja. Otras veces la embarazada es la madre genética, pero el esperma procede de un hombre que ni es su pareja ni tampoco un donante. Cada caso debería resolverse de acuerdo a sus particulares características teniendo en cuenta el interés superior del niño.

Abstract:
This paper analyzes how to determine legal parentage in misplaced embryo cases due to a medical error. There are a wide variety of cases which reflect the tensions between biological and social conceptions of parenthood: sometimes a woman carries in her womb an embryo which genetically belongs to another couple. Other times the pregnant woman is the genetic mother but the sperm comes from a man who is neither her partner nor a donor. Each case should be solved according to its unique characteristics taking into account the best interest of the child.
