The protection of the spouse who might be allotted the family home: posible solutions.

Resumen:
Il legislatore non ha previsto un’adeguata forma di tutela nei casi in cui il genitore proprietario dell’immobile alieni la casa familiare nella fase introduttiva del giudizio di separazione o, comunque, prima dell’udienza presidenziale. Lo studio analizza, in chiave critica, i possibili rimedi, preventivi o successivi alla cessione del bene, elaborati in dottrina e giurisprudenza, auspicando un intervento risolutivo della Corte Costituzionale che permetta di trascrivere la domanda giudiziale volta all’assegnazione della casa familiare. Solo quest’ultima rappresenterebbe, difatti, un’adeguata tutela del prioritario ed infungibile interesse della prole all’habitat domestico, di indiscussa rilevanza costituzionale.
Abstract:
The legislator has not provided for adequate protective measures in the cases in which the parent who owns the house has disposed the house during the introductory stage of the separation proceeding or, in any case, before the hearing presided over by the President of the Court. This essay analyses on a critical perspective the possible solutions, prior or subsequent to the transfer of the asset, which have been elaborated by judicial doctrine and case-laws, while hoping that the Italian Constitutional Court addresses the issue in order to allow registering the claim instituting the civil proceeding to allot the family home. In fact, only the registration of the claim would represent an adequate protection of the primary and nonexchangeable interest of the children to the family home, which has undisputed constitutional importance.
