Resumen:

Tras la promulgación de las últimas leyes en el Derecho autonómico sobre esta institución, a la vista de los avances jurisprudenciales producidos, así como ante la más que inminente sentencia del Tribunal Constitucional que resolverá sobre la constitucionalidad o no de la Ley 5/2011 de la Generalitat Valenciana, en el presente artículo se analiza la situación actual existente en el Derecho autonómico en torno a la institución de la guarda y custodia compartida, así como la previsible situación en la que va a quedar la referida institución en el ámbito de la Comunidad Valenciana ante la hipotética derogación de la Ley de custodia compartida.

Abstract:

This paper reviews the current situation concerning the institution of joint custody in the regional legal system and its eventual development in Valencia region after the expected repeal of the Shared Custody Law following the enactment of the latest regional laws concerning this institution, the jurisprudencial progress made, as well as the imminent judgement of the Constitucional Court regarding the constitutionality of the Law 5/2011 of the Generalitat Valenciana.
